These Terms & Conditions (the “Terms”) govern your use of trucomfortheatingcooling.com (the “Site”) and the heating, cooling, and related services provided by TruComfort Heating and Cooling (“TruComfort,” “we,” “us,” or “our”). By using the Site, requesting an estimate, or accepting our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Services
TruComfort provides residential heating, cooling, indoor air quality, water heater, and related HVAC services in Southington and Central Connecticut. The specific work to be performed is described in the applicable estimate, proposal, or invoice.
2. Estimates, Proposals, and Pricing
Estimates and proposals are based on the information available and the conditions observed at the time they are prepared. Pricing may change if the scope of work changes, if additional issues are discovered, or if site conditions or access differ from what was expected. Where practical, we will communicate material changes before performing additional work. Unless a different period is stated, quotes are valid for 30 days.
3. Payment Terms
For Same-Day Repairs / Maintenance:
- Payment is due upon receipt of the invoice.
For Accepted Proposals:
- A 50% deposit is required for installations. The final 50% is due upon completion. Once the proposal is electronically accepted, a member of our team will be in contact for the next steps.
Accepted payment methods are shown on your invoice. Past-due balances may be subject to late fees and reasonable collection costs as permitted by law.
4. Warranty
We offer a warranty of 12 months on all replaced parts and labor from the date of service. This warranty covers defects in materials and workmanship but does not include issues caused by improper use, lack of maintenance, or unauthorized repairs. Installed equipment may also carry separate manufacturer warranties, which are subject to the manufacturer's own terms and any registration requirements. Warranty service requires that your account is in good standing.
5. Scheduling, Access, and Cancellations
You are responsible for providing safe and timely access to the equipment and work areas. If we are unable to access the property at a scheduled appointment, a trip or rescheduling fee may apply. Please give us reasonable notice if you need to reschedule. Emergency and after-hours service may be billed at different rates, which we will communicate to you.
6. Customer Responsibilities
You agree to provide accurate information, disclose known issues with your systems, keep work areas reasonably accessible, and avoid interfering with or modifying our work in a way that could create a safety hazard or void a warranty.
7. Customer Portal
If you use our customer portal, you are responsible for keeping access to your email account secure, because portal sign-in uses a secure link sent to your email. Information shown in the portal is provided for your convenience and may be updated as our records change.
8. Disclaimers
The Site and its content are provided “as is” for general information. While we strive for accuracy, we do not warrant that the Site is error-free or always available. Rebate, incentive, and financing information is provided as a courtesy and is set by third parties; eligibility and amounts are determined by those programs, not by TruComfort.
9. Limitation of Liability
To the fullest extent permitted by law, TruComfort is not liable for indirect, incidental, special, or consequential damages arising from the Site or our services. Our total liability for any claim related to a service is limited to the amount you paid for that service. Nothing in these Terms limits any liability that cannot be limited under applicable law.
10. Intellectual Property
The Site, including its text, graphics, logos, and design, is owned by TruComfort or its licensors and is protected by applicable laws. You may not copy, reproduce, or reuse our content without permission, except as needed for normal personal use of the Site.
11. Third-Party Links and Programs
The Site may link to third-party websites and programs, such as rebate or financing providers. We are not responsible for the content, policies, or practices of those third parties.
12. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Connecticut.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the “Last updated” date above. Your continued use of the Site or our services after changes are posted means you accept the updated Terms.
14. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. For services, the applicable estimate, proposal, or invoice, together with these Terms, forms the agreement between you and TruComfort.
